Josh,

If you go to fight this, bring some sort of paperwork (like a
newspaper) describing what the weather conditions were on Monday
night. Having the weather clear will be a help, foggy or any mention
of rain would be bad. Unfortunately the moon phase was only at 36%
(not that it was dark yet) so that can't help you.

Anyone remember how Abraham Lincoln became a famous lawyer well before
he was a politician all based on winning a case using the farmer's
almanac to prove that it was not light enough out (0% moon phase) for
the witness to see the crime that they were supposedly a witness to?
