Looking at those pics was bad enough, but after reading the story with it,
my heart grew sick. Made me think of what almost became a simillar situation
while my friend was having his car test driven, he had asked me to ride
along.
I supppose liability issues like this vaery legaly from state to state, but
you've been geting some good advice. Definately your friend should contact a
couple of lawyers on this and find out what can be done in this regard. It
may take some time, but could pan out. If there's no legal liability on the
driver's part, then the lawyers should be sure to explain so and why. In the
mean time, if the car's owner has had it appraised for the asking price or
near that, he should try to use it to his advantage. As well as having copies
of photos before the wreck and of any work done to it that might help to
rationalize the dollar amount he wants.
After dealing with insurance companies when my motorcycle was totaled, I
learned a few things about them. They will hold that check in front of you,
saying that it's the best you can hope for, so why fight it. Most people will
roll over to get what they can as soon as possible. Insurance companies are
there to make money (rather like legal extortion?) and thier claims adjusters
are paid to keep the company from losing money. If they are faced with civil
action, they become more willing to pay the asking price so as to keep the
loss of company money due to legal costs at a minimum.
A much as I hate to say it, legal action may be the best, but slowest,
route for your friend. Be sure to inform him that if he does use this, to
ensure that he has every receipt, ins. appraisal and photo possible to show
that it's worth what he's asking.

On a side note, I'm not sure the driver would have survived if it was my
car, it's likely his head could have impacted the steering wheel. Hard.
